In this illuminating book, Shelley Gavigan argues that the notion of criminalization captures neither the complexities of Aboriginal participation in the courts nor the significance of the Indian Act as a form of law. Gavigan uses records of ordinary cases from the lower courts and insights from critical criminology and traditional legal history to interrogate state formation and criminal law in the Saskatchewan region of the North-West Territories between 1870 and 1905. By focusing on Aboriginal people's participation in the courts rather than on narrow legal categories such as 'the state' and 'the accused, ' Gavigan allows Aboriginal defendants, witnesses, and informants to emerge in vivid detail and tell the story in their own terms. Their experiences -- captured in court files, police and penitentiary records, and newspaper accounts -- reveal that the criminal law and the Indian Act operated in complex and contradictory ways. By showing that the criminal courts were as likely to include acts of mediation as coercion, Hunger, Horses, and Government Men takes the study of criminal law and criminalization in a new direction, one that challenges conventional wisdom and popular images of relations of power and discrimination in the courts"--Provided by publisher. 546 Text in Englsih. 590 eBooks on EBSCOhost|bEBSCO eBook Subscription Academic Collection - North America 650 0 Indians of North America|xCriminal justice system|0https:/ /id.loc.gov/authorities/subjects/sh2006001405 |zSaskatchewan|0https://id.loc.gov/authorities/names/ n79034986-781|xHistory.|0https://id.loc.gov/authorities/ subjects/sh99005024 650 0 Criminal law|0https://id.loc.gov/authorities/subjects/ sh85034058|zSaskatchewan|0https://id.loc.gov/authorities/ names/n79034986-781|xHistory.|0https://id.loc.gov/ authorities/subjects/sh99005024 650 0 Criminal courts|0https://id.loc.gov/authorities/subjects/ sh85034040|zSaskatchewan|0https://id.loc.gov/authorities/ names/n79034986-781|xHistory.|0https://id.loc.gov/ authorities/subjects/sh99005024 650 0 Criminal justice, Administration of|0https://id.loc.gov/ authorities/subjects/sh85034049|zSaskatchewan|0https:// id.loc.gov/authorities/names/n79034986-781|xHistory. |0https://id.loc.gov/authorities/subjects/sh99005024 650 5 Native peoples|xLegal status, laws, etc.|zSaskatchewan. 650 5 Native peoples|zSaskatchewan|xGovernment relations. 650 7 Indians of North America|xCriminal justice system.|2fast |0https://id.worldcat.org/fast/1766869 650 7 History.|2fast|0https://id.worldcat.org/fast/958235 650 7 Criminal law.|2fast|0https://id.worldcat.org/fast/883328 650 7 Criminal courts.|2fast|0https://id.worldcat.org/fast/ 883184 650 7 Criminal justice, Administration of.|2fast|0https:// id.worldcat.org/fast/883246 650 7 Criminal law.|2homoit|0https://homosaurus.org/v3/ homoit0000313 651 7 Saskatchewan.|2fast|0https://id.worldcat.org/fast/1204834 655 0 Electronic book. 655 4 Electronic books. 655 7 History.|2fast|0https://id.worldcat.org/fast/1411628 655 7 Electronic books.|2lcgft 710 2 Osgoode Society for Canadian Legal History.|0https:// id.loc.gov/authorities/names/nr94025941 776 08 |iPrint version:|aGavigan, Shelley A.M.|tHunger, horses, and government men.|dVancouver : Published by UBC Press : for the Osgoode Society for Canadian Legal History, 2012 |z9780774822527|z077482252X|w(DLC) 2012474184 830 0 Law and society series (Vancouver, B.C. : Online) 856 40 |uhttps://rider.idm.oclc.org/login?url=http:// search.ebscohost.com/login.aspx?direct=true&scope=site& db=nlebk&AN=494043|zOnline eBook via EBSCO.
