A number of commentators have pointed to Australian administrative law as evidence for this 'righting' hypothesis. They have suggested that the fact that Australia is an outlier among common law jurisdictions in having neither a statutory nor a constitutional framework to expressly protect human rights explains why Australia alone continues to take an apparently 'formalist', 'legalist' and 'conservative' approach to administrative law. Other commentators and judges, including a number in Canada, have argued the opposite: that bills of rights have the effect of stifling the development of the common law. However, for the most part, all these claims remain just that - there has been limited detailed analysis of the issue, and no detailed comparative analysis of the veracity of the claims. This book analyses in detail the interaction between administrative and human rights law in Australia and Canada, arguing that both jurisdictions have reached remarkably similar positions regarding the balance between judicial and executive power, and between broader fundamental principles including the rule of law, parliamentary sovereignty and the separation of powers. It will provide valuable reading for all those researching judicial review and human rights. 588 0 Online resource; title from digital title page (viewed on May 17, 2017). 590 eBooks on EBSCOhost|bEBSCO eBook Subscription Academic Collection - North America 650 0 Judicial review of administrative acts|zAustralia.|0https: //id.loc.gov/authorities/subjects/sh2009127966 650 0 Administrative law|0https://id.loc.gov/authorities/ subjects/sh85000913|zAustralia.|0https://id.loc.gov/ authorities/names/n79021326-781 650 0 Civil rights|zAustralia.|0https://id.loc.gov/authorities/ subjects/sh2009119847 650 0 Judicial discretion|0https://id.loc.gov/authorities/ subjects/sh85070942|zAustralia.|0https://id.loc.gov/ authorities/names/n79021326-781 650 0 Judicial review of administrative acts|zCanada.|0https:// id.loc.gov/authorities/subjects/sh2008122575 650 0 Civil rights|zCanada.|0https://id.loc.gov/authorities/ subjects/sh2008101031 650 0 Judicial discretion|0https://id.loc.gov/authorities/ subjects/sh85070942|zCanada.|0https://id.loc.gov/ authorities/names/n79007233-781 650 7 Judicial review of administrative acts.|2fast|0https:// id.worldcat.org/fast/984732 650 7 Administrative law.|2fast|0https://id.worldcat.org/fast/ 796846 650 7 Civil rights.|2fast|0https://id.worldcat.org/fast/862627 650 7 Judicial discretion.|2fast|0https://id.worldcat.org/fast/ 984652 650 7 Human rights & civil liberties law.|2bicssc 650 7 International law.|2bicssc 650 7 Comparative law.|2bicssc 650 7 Constitutional & administrative law.|2bicssc 650 7 LAW|xCivil Procedure.|2bisacsh 650 7 LAW|xLegal Services.|2bisacsh 650 7 POLITICAL SCIENCE|xGovernment|xJudicial Branch.|2bisacsh 651 7 Australia.|2fast|0https://id.worldcat.org/fast/1204543 651 7 Canada.|2fast|0https://id.worldcat.org/fast/1204310 655 4 Electronic books. 776 08 |iPrint version:|aBoughey, Janina.|tHuman rights and judicial review in Australia and Canada.|dOxford [UK] ; Portland, Oregon : Hart Publishing, 2017|z9781509907861 |w(DLC) 2017002142 830 0 Hart studies in comparative public law ;|0https:// id.loc.gov/authorities/names/no2013062952|vv. 16. 856 40 |uhttps://rider.idm.oclc.org/login?url=https:// search.ebscohost.com/login.aspx?direct=true&scope=site& db=nlebk&AN=1510265|zOnline ebook via EBSCO.
